Terms of Service

Last updated: August 31, 2026 · These terms are between you and BigTopa, LLC ("GatherAgain").

These terms govern access to and use of the GatherAgain platform. By creating an account, joining a group, or buying a ticket, you agree to them. If you're agreeing on behalf of a group or organization, you represent that you're authorized to bind it.

The service

GatherAgain provides software for groups to plan reunions and events, collect payments and contributions, communicate, and share memories — and to hibernate between gatherings. Features available to you depend on your plan and configuration.

Accounts & eligibility

You must provide accurate information, keep your credentials secure, and be responsible for activity under your account. You must be of legal age to form a binding contract. Organizers are responsible for the conduct of their co-organizers and members on the platform.

Acceptable use

• Don't use the service for unlawful, fraudulent, or deceptive fundraising or ticket sales.
• Don't misrepresent an event, what a payment covers, or how funds will be used.
• Don't upload unlawful, infringing, harassing, or harmful content, or share photos or contact details in violation of others' privacy.
• Don't add people to a group or mailing list without a reasonable basis for contacting them.
• Don't disrupt, reverse-engineer, or attempt to gain unauthorized access to the service.

Organizers run the event, not us

The organizer is solely responsible for their event: the venue, the date, safety, staffing, permits, insurance, what is promised to attendees, and delivering it. GatherAgain is not the event organizer, host, promoter, or seller of record. We provide the software that organizers use to sell tickets and collect funds. Any dispute about an event is between the attendee and the organizer.

Payments, refunds & cancellations

Payments are processed by Stripe and other providers, subject to their terms. Organizers set ticket prices, contribution amounts, and their own refund and cancellation policy, and are responsible for honoring it, for the tax treatment and disbursement of funds they collect, and for their own entity and tax status. If an event is cancelled, changed, or under-delivers, the organizer is responsible for refunds. Platform fees, processing fees, and subscription charges are described in your order or at pricing and are non-refundable except as required by law or expressly stated.

Hibernation & reactivation

A group can hibernate between reunions. While hibernating, the group keeps its data and can be reactivated by an organizer, and we stop sending communications on its behalf. Dormant groups may be deleted or anonymized after 24 months of inactivity following notice to organizers, as described in our privacy policy.

Your content

You retain ownership of the photos, posts, and other content you upload, and grant us a limited license to host and process it solely to provide the service. You are responsible for having the right to share what you upload, including photos of other people. Organizers control what is shared inside their group and can remove content.

Intellectual property

GatherAgain and its software are owned by BigTopa, LLC and its licensors. School names, class years, and other marks remain the property of their respective owners.

Disclaimers

The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee attendance, fundraising results, or the quality or safety of any event.

Limitation of liability

To the fullest extent permitted by law, GatherAgain will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost funds, data, or goodwill, or for any injury, loss, or dispute arising from an event itself. Our total liability for any claim is limited to the amount you paid us for the service in the 12 months before the claim.

Termination

You may stop using the service at any time. We may suspend or terminate access for violation of these terms or to protect the service or its users. On termination, organizers may export their group's data subject to applicable law and record-keeping requirements.

Changes

We may update these terms from time to time. We will post the updated version here and revise the "last updated" date; continued use after changes take effect constitutes acceptance.

Governing law

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of New Castle County, Delaware, unless otherwise required by law.
